Terms of Use (Agreement)

IMPORTANT INFORMATION
These Terms of Use (the Terms or the Agreement) govern the relationship between the customer (you or the customer) and TÝR Markets AS (TÝR Markets, we or us) when you use our platform or app to:
Exchange crypto-assets for funds
Buy, sell, deposit, and/or withdraw crypto-assets or fiat currencies
Transfer crypto-assets to other wallets (ledgers).
ABOUT US
TÝR Markets AS (TÝR Markets or we/us) is a Norwegian domiciled and regulated Crypto-Asset Service Provider (CASP) authorised to provide the following crypto-asset services, cf. MiCA art. 3 no. 1 (16):
a) Providing custody and administration of crypto-assets on behalf of clients
b) Exchange of crypto-assets for funds
c) Exchange of crypto-assets for other crypto-assets
d) Providing transfer services for crypto-assets on behalf of clients
We are authorised as a CASP by the Norwegian Financial Supervisory Authority under the Norwegian Act of 27 May 2025 no. 20 on crypto assets (Nw: kryptoeiendelsloven), implementing the EU Markets in Crypto-Assets Regulation (MiCA), and are subject to anti-money laundering supervision.
We offer a platform for exchanging crypto-assets for fiat currencies,providing transfers of crypto-assets on behalf of clients, and providing custody and administration of crypto-assets (collectively in this Agreement the Services).
The Services are limited to the specific crypto-assets and fiat currencies we may accept at any time, which may change without notice.
TÝR Markets is registered in the Brønnøysund Register with organisation number 933 052 826, and has its head office at Ruseløkkveien 34, 0251 OSLO.
PLEASE READ THESE TERMS CAREFULLY BEFORE YOU SIGN THE AGREEMENT.
BY CREATING AN ACCOUNT AND USING THE SERVICES, YOU CONFIRM THAT YOU HAVE READ AND ACCEPTED THIS AGREEMENT.
To use our Services, you must be at least 15 years old.
When you use our Services to buy, deposit, hold, withdraw or sell crypto-assets, you will not be protected by a Norwegian deposit guarantee scheme. If you have a complaint, it might also fall outside the scope of the jurisdiction of the Norwegian financial complaints handling scheme (Finansklagenemnda).
TÝR Markets does not provide any investment advice relating to our Services. You should carefully consider whether your personal situation and the financial risks you are willing to take mean that you should not buy crypto-assets.
Security systems
We aim to provide the Services through proven security systems and practices. To this end, our platform is wholly cloud-based, using a reputable cloud provider, and using end-to-end encryption. We will not accept any withdrawals of fiat currencies or crypto-assets from your account held with us unless you activate two-factor authentication of your account, as instructed by us.
All transactions made by you will be monitored in real time by us for KYC, anti-money and anti-terrorist financing purposes and fraud detection purposes.
When applying to create an account, you must provide your full name, residential address, residency status, national identity number or D-number, as well as other legally required information, including information about the purpose and intended nature of the customer relationship, the origin of funds and tax affiliation. In addition, you must provide us with your e-mail address and cell phone number. Order confirmations and other important information concerning your customer relationship will be sent to you by e-mail. All order confirmations and other important information about your customer relationship, including full transaction history, will also be available on the platform.
If you have neither a national identity number nor a D-number, you must provide date of birth, place of birth, citizenship and gender. You must identify yourself through approved electronic identification and confirm the accuracy of the information.
We reserve the right to reject, suspend, or terminate any customer relationship if, in our sole discretion, the results of our know-your-customer (KYC) verification are unsatisfactory, or if you fail to provide the documentation or information required to comply with applicable anti-money laundering (AML) and counter-terrorist financing (CTF) regulations.
TÝR Markets also reserves the right to refuse to establish or maintain your customer relationship where there is reason to believe that the information provided is false, incomplete, or otherwise insufficient to perform adequate due diligence, or if there is suspicion of money laundering, terrorist financing or other fraudulent behavior.
Use of the Services requires an e-money account at Espos Norge AS (Espos), whom we co-operate with. Espos is domiciled and licensed in Norway as an e-money company. By entering into this Agreement, you authorize us to enter into an account agreement with Espos on your behalf in accordance with Appendix 1 (which is considered part of the Agreement), on the terms set out therein.
On Espos' e-money platform, individual e-money accounts are created per customer, with corresponding e-money balance based on the customer's deposited fiat amount.
Espos will use a client account for all fiat deposits from you. The funds held as e-money in the client account are thereby secured against bankruptcy at Espos and/or TÝR Markets. This only applies to funds deposited in NOK or other fiat currency to your e-money account at Espos. Crypto-assets are not e-money and are not held with Espos.
Espos' liability is limited to tasks related to the e-money platform, including fiat deposits and withdrawals of fiat to/from the e-money platform. Withdrawals of e-money from your e-money account to TÝR Markets for payment of orders in crypto-assets, distribution of funds from TÝR Markets to your e-money account for crediting of orders in crypto-assets and withdrawals of e-money and conversion to fiat currency made by you are based on data from TÝR Markets. Espos is not responsible for the accuracy of information received from TÝR Markets.
Your digital wallet on our platform and the e-money account at Espos (client account) together constitute your Account.
When you buy and sell crypto-assets at our platform, all orders are concluded with us as your direct counterparty and are conducted on an over-the-counter basis.
You can buy or sell crypto-assets at our platform, debiting or crediting e-money held in your Account, in the following ways:
You can place an order to buy or sell crypto-assets straight away at the current market price we are offering you (spot order).
You can set up an order to buy or sell crypto-assets in the future, if the exchange rate hits the target rate you set (limit order).
You can set up an order to buy or sell crypto-assets in the future, where execution is conditional upon a target price decided by you is being reached (trigger order).
Limit orders enable you to place an order to exchange at a specific price (target price), where orders only will be fulfilled at or below such price limit. The execution price may differ substantially from the target price you have set, depending on, inter alia, volatility and liquidity in the market.
Trigger orders enable you to place an order where execution is conditional upon a target price being reached. The execution price may differ substantially from the trigger price, depending on, inter alia, volatility and liquidity in the market.
You can only place an order on our digital platform when logged in. We do not accept orders by any other means (such as e-mail, direct messaging, phone).
The time of receipt of orders (order date and time) is when you order is confirmed on the platform (as a starting point, instantaneously).
Spot orders
If you submit a spot order, we will follow these procedures:
In the order form at the platform, you must tell us how much fiat (e-money) you want to spend or receive, and we will let you know how much of a crypto-asset you can buy or sell, using the exchange rate at the time of your request.
We will present you with a quoted price shown at the order confirmation table, along with the relevant transaction details, such as applicable fees, any spread/slippage and other trade details (the quote).
If you approve our quote by confirming your order, we will fulfil your instructions. Your order will then become binding and final.
We will send you an order confirmation with order details to your designated e-mail address immediately after we have concluded your order. The order details will also appear in your transaction history at the platform.
Please be informed that in fast-moving markets, if there is very thin liquidity in the market, or in other extraordinary circumstances, we cannot guarantee that 100% of your order will be filled, even when we have given you a quote. We assume no liability for any losses you may incur if your order is not filled, or only partially filled. Your trade confirmation will always contain information on how much of your order that was filled, the exact trade price and the transaction costs for (partial) conclusion of the order, and any spread/slippage.
By confirming a spot order, you give us permission to debit and credit your Account for the purchase price or the sales proceeds (as the case may be) and to transfer an amount of e-money equivalent to the value of your spot order without any further instruction from you.
In case of insufficient balance in your Account, or if the spot order is below the minimum value we require for spot orders at any time, we will reject your order.
Quotes are valid only for a limited period of time and can be subject to change during the period in which you can accept them. If not accepted promptly, the quote will expire.
If the value of your requested spot order is less than the minimum order size determined by us, if there is insufficient balance of fiat currencies (e-money) or crypto-assets in your Account, we will reject your order.
Limits of orders
We may limit the amount of crypto-assets you can buy or sell with us. If your order is below or above the limit we accept at any time, your order will be rejected. You will be informed through the order confirmation table that your order was rejected.
Rejecting request for orders
Sometimes we may reject your request to buy or sell crypto-assets. If this happens with your order, you will be notified in the order table that your order was rejected and thereby not concluded. We will not be responsible for any loss of profits or other financial losses you may suffer because of our rejection.
We may reject your order, inter alia, if:
There are not enough crypto-assets available in the market
There is not enough e-money or crypto-assets in your Account
Our Services is temporarily unavailable, or if one of the exchanges or liquidity providers we work with to provide our Services are not available
We have good reason to suspect that your instruction was for illegal purposes (for example, to commit fraud)
We have good reason to believe complying with your instruction would be contrary to law, a court order or written supervisory practice applicable to TÝR Markets
In exceptional circumstances, we reserve the right to determine, acting reasonably, whether an extraordinary event has occurred that prevents us from fulfilling a final and binding order. Such events may include (but are not limited to) system failures, data feed errors, service interruptions or delays or other unforeseen circumstances beyond our control.
If such an event occurs, we will notify you as soon as reasonably possible. Once notified, you acknowledge and agree that we will not be obligated to complete the affected transaction, and that it will be considered as having been cancelled.
Cancelling your orders
Once you have placed a spot order with us and accepted our quote, your spot order is final and cannot be cancelled by you.
You can only cancel a limit order or trigger order before your target rate is hit. Please be advised that if you have placed a limit order or trigger order with us, it will remain open for an unlimited duration of time until the limit order or trigger order is filled entirely (which may happen in one or several separate transactions, depending on, inter alia, market conditions and market liquidity) or until you cancel the order yourself.
You can never cancel any spot order to buy or sell crypto-assets once the order is confirmed.
Advanced trading functionality
We offer trigger orders and limit orders for exchange of crypto-assets for funds.
Trigger orders enable you to place an order where execution is conditional upon a target price being reached. Please be advised that the actual execution price may differ substantially from the trigger price you have set. We cannot guarantee that a trigger order will be executed at the target price you have set. In fast-moving markets or where there is thin liquidity in the market, trigger orders may be partially or wholly executed at substantially higher or lower prices than the target price you have set.
Limit orders enable you to place an order to exchange at a specific price, where orders only will be fulfilled under such price limit. Please be advised that the actual execution price may differ substantially from the limit price you have set. We cannot guarantee that a limit order will be executed at the target price you have set. In fast-moving markets or where there is thin liquidity in the market, limit orders may be partially or wholly executed at substantially lower prices than the target price you have set.
Due to the market infrastructure for crypto-assets, limit orders and trigger orders will remain in effect until completion and will not automatically lapse.
We cannot guarantee that trigger orders or limit orders are filled, partially or completely, even if the trigger price you have set was crossed. When placing a limit order or trigger order, you accept that the order may not be executed at all, may only be partially executed, or may be partially or wholly executed at substantially higher or lower prices than the target price you have set. We accept no liability for any losses of profits, trading losses or other losses you may incur when placing limit orders or trigger orders.
Fulfilment of orders are always subject to sufficient funds in your Account. When placing trigger orders, fiat currencies (e-money) are not reserved upon placing the order. When placing a limit order, fiat currencies (e-money) are reserved and unavailable for other trading until cancellation of the order.
We reserve the right to cancel limit orders and trigger orders at any time, and/or to reject such orders. You will be notified of such cancellation or rejections.
Deposits and withdrawals of NOK or other fiat currencies we accept must be made through your e-money account at Espos. You can deposit directly to your Account from your designated bank account through our integration with Neonomics (shown as "Nello Pay"). Deposit instructions are shown under "Deposits" when you click "NOK" or any other currency we accept.
Withdrawals depend on sufficient amounts in NOK or any other currency we accept being made available by you through us, possibly through exchange.
When withdrawing funds (fiat currency) from your e-money account, Espos will transfer funds from your e-money account to the bank account you have specified to us for deposits and withdrawals during customer registration or as subsequently notified and accepted by TÝR Markets. Instructions to withdraw to a bank account not owned by you will not be accepted.
Exchange of crypto-assets for funds
TÝR Markets provides exchange of crypto-assets for funds (fiat currency). All orders are made with us as your counterparty.
Following your instructions to exchange crypto-assets for funds or funds for crypto-assets (or crypto-assets for other crypto-assets) at a specified and agreed exchange rate, the amount instructed is exchanged and the resulting crypto-assets or funds are credited to your Account. We will send you an order confirmation with order details to your designated e-mail address immediately after an order has been concluded with us as your counterparty.
Please be informed that in fast moving markets, where there is thin liquidity in the market, or in other exceptional circumstances, we cannot guarantee that 100% of your order will be filled, even if we have provided you with a quote. We accept no liability for any loss of profits or other financial losses you may suffer in such cases. Your trade confirmation will contain information on how much of your order that was filled, at what trade price and the transaction costs for concluding the order, including any spread/slippage.
Settlement for purchases of crypto-assets you buy from us is transferred from your Account (funds) to TÝR Markets' e-money account, and the purchased crypto-assets are credited to your Account.
Settlement for sales of crypto-assets you sell to us results in funds being transferred from TÝR Markets' e-money account to your Account, and the sold crypto-assets are debited from your Account.
All crypto-assets held in your Account are subject to custody and administration by TÝR Markets in accordance with section 3 below.
Deposits and transfers of crypto-assets from and to external wallets
Depositing crypto-assets from external wallets
You can deposit crypto-assets into your Account from an external address.
Transfer instructions for deposits are received by TÝR Markets after they have been processed on the blockchain. TÝR Markets then performs its internal checks before processing the deposit into your account.
We do not charge any fees to deposits, nor do we receive any fee payment. Your originating wallet or third-party service may charge a fee (including, bit not limited to, gas fee ) for the transaction, as it is a withdrawal from that location.
We only support deposits for the same crypto-assets we offer exchange with/trading in. If we support deposits for a certain crypto-asset, it will appear on the list of crypto-currencies we support, under "Deposits". We only support native networks for such crypto-asset.
When clicking on the crypto-currency you want to designate for a deposit, a deposit address will be created uniquely for you. You must not in any circumstances use that address to deposit a different crypto-asset. Any deposit to that designated address for unsupported or different crypto-assets may be permanently lost, and we will not be liable for any losses you suffer as a result of this.
Please be informed that if you close your Account, or the Account is in the process of being closed, you must never attempt to send any crypto-assets to any deposit address with us. If you do, any crypto-assets sent to your deposit address may be permanently lost, and we will not be liable for any losses you or others incur by attempting to do this.
There are minimum deposit thresholds for certain crypto-assets. Because network fees fluctuate, the stated minimum deposit threshold for these crypto-assets is subject to change at any time and without notice. When you indicate that you want to deposit a particular crypto-asset that we support, it will appear in the "Deposit" section whether it is subject to a minimum deposit threshold, and what the applicable threshold is.
Please note that deposits of crypto-assets below the minimum deposit threshold will not be credited your Account.
You will always have beneficial ownership of any crypto-assets you deposit with us. If you want to sell or withdraw your deposited crypto-assets that are below the minimum threshold, the easiest and quickest way to do this is to make another purchase of a small amount of the same crypto-asset, or to make a further deposit of the same crypto-asset to the same deposit address, so that your aggregate deposit amount in this particular crypto-asset meets the minimum threshold for sales orders or transfers (withdrawals to an external wallet).
Transferring crypto-assets to an external wallet
You can transfer crypto-assets from your Account to another wallet held with us or to an external wallet. We will charge a gas fee for such transfers. The gas fee will always be shown to you before you submit your instruction.
Transfer instructions for withdrawals are received by TÝR Markets immediately after submission by you. After submission, TÝR Markets performs its internal checks before submitting the transaction to the respective blockchain. This may result in a delay of up to 30 minutes before a user withdrawal instruction is submitted to the blockchain.
The estimated time and number of block confirmations needed for the transfer to be irreversible on the DLT network is displayed before you give us a transfer instruction and can no longer cancel it.
Regulatory obligations concerning deposits and transfers
To comply with our regulatory obligations, we may be required to:
Collect certain information from you before or after processing your order for transfer to an external wallet, share that information to the host of that external wallet and verify that the external wallet is owned or controlled by you.
Collect and verify information about a transfer from an external wallet, and carryout a risk assessment on the deposit, before making it available to you
We may freeze and retain a deposit or transfer, return an attempted transfer from your Account, or return an attempted transfer to its source, where:
You do not provide the information we need to process or release a deposit or transfer, or we have good reason to suspect that information you have provided is incorrect or false
We receive insufficient information about a deposit from an external wallet, or the information does not match our records about who the intended beneficiary of the deposit is
The host of an external wallet rejects and returns your withdrawal to us
We will inform you of the reason for any such freeze or other measure to the extent legally permissible. You acknowledge that we are prohibited from sharing information with you in case of suspicion of transactions related to money laundering and/or terrorist financing.
You may be charged any network and service fees associated with returning a deposit to its source, or returning a withdrawal to you where it is rejected by the host of an external wallet.
We also apply financial crime and sanctions checks to deposits and transfers, which may result in us:
Freezing a deposit or withdrawal, and asking you for additional information before processing or releasing a deposit or withdrawal
Blocking deposits to, or withdrawals from, certain external wallet addresses
Freezing and retaining deposits from a source that has been identified as being sanctioned, until applicable sanctions change, or you receive a "Release of BlockedFunds" licence from an appropriate sanctions organisation
When a deposit or transfer is blocked, frozen, or returned, we will store and process this information in accordance with our legal and regulatory obligations. We may also share this information with third parties we cooperate with for financial crime prevention purposes.
Rejecting your instructions
We may (but are not under any obligation to) reject your instructions to deposit, withdraw or transfer crypto-assets when:
There are not enough crypto-assets available in your Account
Our Services is temporarily unavailable, or if one of the exchanges or liquidity providers we work with to provide our Services are not available
We have good reason to suspect that your instruction was for illegal purposes (for example, to commit fraud)
We have good reason to suspect that your instruction is not authorised by you
We have good reason to believe complying with your instruction would be contrary to law, a court order or written supervisory practice applicable to TÝR Markets
Liability for losses
We do not accept any liability for any losses suffered by you as a consequence of, or in connection with, any orders, trades or other decisions or activities made by you using the Service or the Account.
We do not accept any liability for any losses you or others incur related to a withdrawal, deposit or transfer of crypto-assets to or from an external wallet, including as a result of the following:
Crypto-assets that we do not support
Wrong designated address for a specific crypto-asset (for example, you deposit Ethereum to your TÝR Markets Bitcoin deposit address)
Transfer of crypto-assets to an external wallet and the crypto-assets are lost or not possible to retrieve after the transfer is completed (for example, you input incorrect recipient information or send the crypto-assets to a recipient that turns out to be a fraudster)
Transfer to TÝR Markets when your Account is closed, or is in the process of being closed
A deposit, withdrawal or transfer is blocked, frozen due to measures to combat money laundering, sanctions screening or technical error outside the control of TÝR Markets
We refuse your instructions to deposit, withdraw or transfer crypto-assets
Please be informed that we will not be able to reverse any deposits, withdrawals or transfers as these transactions are irreversible. Therefore, always make sure that you enter the correct deposit, withdrawal or transfer address before you submit your instructions. Crypto-asset wallets do not support pre-validation technology such as bank accounts (KAR-register or similar). We will not be responsible for any losses you may suffer as a result of making a mistake entering the deposit or withdrawal address.
No possibility to cancel your transfer instructions
Transactions in crypto-assets are irreversible. This means that you cannot cancel an instruction to transfer crypto-assets once you have confirmed the order. We are unable to reverse an order for transfer once execution has commenced, as execution is near instantaneous.
TÝR Markets provides custody and administration of crypto-assets on behalf of customers. This service is provided free of charge, solely in connection with your exchange and deposits/withdrawals of crypto-assets through your Account.
TÝR Markets has adopted a custody policy to minimise the risk of loss of customers' crypto-assets as a result of fraud, cyber threats or negligence. A copy of this policy is available on our website.
Your crypto-assets held in the Account may be held in an omnibus account together with the crypto-assets of other customers. Such crypto-assets are segregated operationally and at blockchain level from our own holdings. The means of access to clients' crypto-assets are identified as client funds and kept separate from our own means of access.
TÝR Markets maintains a register of positions and transactions in each customer's name at the level of each customer Account, with movements registered as soon as possible. Your position statement is available via the platform, identifying type of crypto-assets, balance, value (in NOK), and transfers during such period (in full calendar days) you select. We will generate a periodic statement with cash value as at each quarter end. We will provide you as soon as possible with any information about operations on crypto-assets that require your response, including a description of any alternatives and relevant deadlines in relation to such response.
Where relevant, TÝR Markets facilitates exercise of rights attached to crypto-assets (e.g. voting rights, airdrops, forks, staking where supported). Upon changes to blockchain technology or other events creating or modifying rights (e.g. hard forks, airdrops, token swaps (hereinafter "operations")), customers are entitled to any newly created crypto-assets or rights based on their positions at the time of the event, unless a prior agreement explicitly provides otherwise. TÝR Markets has a right to decline supporting an operation if, supporting the operation would be, in the view of TÝR Markets, having made due inquiry:
(a) contrary to law, a court order or written supervisory practice applicable to TÝR Markets,
(b) fraudulent,
(c) technically imprudent (due to security concerns), or
(d) disproportionately costly.
TÝR Markets has the burden of proof. In cases mentioned in (c) and/or (d), TÝR Markets will endeavour to ensure that you may benefit from such rights by alternative means, such as transfer to another service provider.
TÝR Markets can only be held liable for loss of and loss of access to your crypto-assets or means of access as a result of incidents attributable and to the extent attributable to us.
Non-attributable incidents include, but are not limited to:
(a) malfunction, alteration or other issues with the blockchain protocol,
(b) blockchain protocol vulnerabilities or consensus attacks,
(c) your actions or omissions (sharing personal codes/security information in breach of section 4.3 or as a consequence of phishing or other fraud)
(d) force majeure, meaning circumstances beyond our reasonable control including but not limited to acts of God, war, terrorism, riots, civil unrest, government actions, sanctions, embargoes, natural disasters, fires, floods, epidemics, pandemics, power failures, internet or telecommunications failures, or failures of third-party infrastructure.
TÝR Markets has the burden of proof.
You must immediately notify us of any suspected loss or loss of access of which you become aware via the platform or via e-mail to support@tyrmarkets.net.
Our liability is limited to the market value of the crypto-asset at the time of loss / loss of access.
As with the protocols for other crypto-assets, TÝR Markets neither owns nor controls any underlying protocol or distributed ledger technology. TÝR Markets assumes no responsibility for the operation of the underlying protocols and we do not guarantee the functionality or security of network operations. You acknowledge and accept the risk that underlying software protocols relating to any crypto-asset safekept may change.
This section takes precedence over section 9 for custody matters.
TÝR Markets may make use of other crypto-asset service providers in connection with custody and administration of crypto-assets on your behalf.
We charge commission for buying, selling and exchanging crypto-assets (transactions) according to the current price list. Our commission will be disclosed when you place an order, before your confirmation. The same applies to any spread between the buy price and sell price on the relevant crypto-assets you place an order for.
We strive to always be able to offer 0% spread on all trades up to the equivalent of NOK 1,000,000 in the crypto-assets our Services relate to, but this is not guaranteed. On trades above the equivalent of NOK 1,000,000, we strive to always offer highly competitive spread, and among the lowest possible in the Norwegian market.
Our ability to offer 0% spread depends on the crypto-asset and the order size. An overview of the crypto-assets we offer trading in, which crypto-assets we can offer (approximately) 0% spread in and which amount limits apply at any time for this goal on our part, can be found on our website.
During weekends, national and international banking holidays, there can or will be a minimum spread of 0.10% on all orders above NOK 1,000,000, regardless of volume, due to the fiat currency market being closed.
Any spread that applies to your order will always be shown when you place your order, before your confirmation.
Regardless of the amount limits mentioned above, we strive to ensure that the spread we offer on customers' orders when trading in crypto-assets with us are at all times among the lowest possible in the Norwegian market.
When we use the term "Zero Spread" or "0% spread" on our websites, in our marketing, in this Agreement or elsewhere, this should be understood with the clarifications and limitations stated above, i.e. as a goal, and not as a guarantee.
Once you have given your confirmation that you wish to execute the order on the terms and conditions shown to you, including commission and any spread/slippage, the order is final and cannot be recalled or cancelled by you.
In addition to commission to us and any spread, actual transaction costs (at cost, without any markup) that Espos pays to its bank for all deposits and withdrawals of fiat currency from/to your Account to/from you are incurred.
You confirm that you will only use the Account and the Services for lawful purposes. We reserve the right to stop the Services, freeze your Account and/or terminate the Agreement if we detect reasonable suspicion of breach of this requirement.
The customer relationship and the Account are personal and can only be used by you. Joint trading/investment together with others in your name via the Account/Services is not permitted and will provide grounds for termination of the Account and the Agreement, including freezing of the Services. You must take all reasonable precautions to protect personal codes and/or other security information related to the Account.
The personal codes/security information must not be disclosed or made available to anyone, including us, family members or the police. The codes/security information must not be used under circumstances where others can see or become aware of them.
You must notify us (on support@tyrmarkets.net) as soon as possible if you become aware of unauthorised or incorrectly executed transfers, loss, theft or unauthorised use or appropriation of personal code/security information, and/or mobile phone, digital device or other equipment to which the Account is linked, unauthorised access to the Account, that unauthorised persons have gained knowledge of personal code and/or other personal security information, or unauthorised use.
TÝR Markets’ liability for such transactions will be determined in accordance with applicable Norwegian laws. This incorporates liability caps in the event of erroneous actions by TÝR Markets. In such cases, these liability caps are limited to the value of the crypto transfer in question. See also section 7 below.
We may immediately terminate the Agreement, the Account and/or suspend provision of the Services after written notice if we reasonably believe that you have materially breached or circumvented the terms of the Agreement, or relevant legislation, including anti-money laundering legislation or sanctions rules.
You may terminate the Agreement with 10 days' written notice to us.
Termination of the Agreement does not affect obligations already incurred or orders already confirmed.
Termination of the Agreement – by you or us – simultaneously means termination of the customer agreement with Espos.
Crypto-assets exist as part of a digital and partially anonymous system, based on peer-to-peer networks and cryptography to maintain its integrity.
Crypto-assets may be subject to a variety of changes in markets, demand, regulations, competition and other conditions that are difficult to predict and all of which may weaken confidence in the crypto-assets being traded, and affect value and/or liquidity.
Trading platforms may themselves be vulnerable to technical challenges and security challenges, such as the risk of hacking, which may lead to transactions not being executed on time, not being executed at all, or values being stolen.
We will attempt to provide updated risk information in line with changes in markets, regulations and practices, but will never be able to provide any exhaustive information about risk. As there may be unknown risks or risks whose significance cannot be assessed, you should carefully consider your own risk tolerance and your current financial situation against the inherent risk in digital assets and/or trading in crypto-assets.
Any decision you make to use the Services and trade is your own independent decision. You confirm that you are not relying on any information (given orally or in writing) from us as investment advice or as any recommendation to use the Services. We will not provide investment advice to customers and will never take a position on whether customers should invest in crypto-assets or not. We will never comment on whether the value of a specific crypto-asset is expected to rise or fall in the future. All investment is entirely at your own risk.
By registering an Account, entering into this Agreement and otherwise using the Services, you confirm that you are aware of the risk factors mentioned above and that we have no liability for any form of loss suffered by you as a result of or in connection with trades or other decisions or dispositions made by you when using the Services or the Account.
Entering into the Agreement is binding and you have no right of withdrawal, as the Agreement relates to the delivery of goods or Services where the price depends on fluctuations in the financial market that may occur within the expiry of the withdrawal period and which cannot be controlled by us, cf. Act of 20 June 2014 no. 27 on the right of cancellation Section 22 first paragraph letter d. You have no right of cancellation of the Services when placing an order to buy, sell or transfer crypto-assets.
We reserve the right to change, suspend or discontinue the Services at any time, without liability. This applies to both operating hours and availability of features.
All transfers or movements of digital assets initiated by you shall be carried out solely based on the unique identifier provided by you (including wallet addresses, account numbers, or other transaction references). A transfer executed according to the provided unique identifier shall be deemed to have been correctly executed with respect to the intended recipient, regardless of any other information supplied by you.
TÝR Markets shall not be liable for any loss, delay, or error arising from a transfer where the unique identifier provided by you is incorrect, incomplete, or invalid. You bear the full risk for any such error, including, but not limited to, misdirected transfers or loss of funds.
We have no liability for any form of loss suffered by you as a result of or in connection with trades or other decisions or dispositions made by you when using the Services or the Account.
We do not accept any liability for any losses you or others incur related to a withdrawal or deposit of crypto-assets to or from an external wallet, including (but not limited to) as a result of the following:
• You deposit crypto-assets that we do not support
• You deposit wrong type of crypto-assets to the designated address for a specific crypto-asset (for example, you deposit Ethereum to your TÝR Markets Bitcoin deposit address)
• You withdraw crypto-assets to an external wallet and the crypto-assets are lost or not possible to retrieve after the transfer is completed (for example, you send the crypto-assets to a recipient that turns out to be a fraudster)
• You attempt to deposit crypto-assets to your deposit address with TÝR Markets once your Account is closed, or is in the process of being closed
• A transfer is blocked, frozen, or returned by a recipient institution
• We refuse your instructions to deposit, transfer or withdraw crypto-assets in accordance with this Agreement
We do not advise on the characteristics of any transaction, risks in trading or tax consequences, or otherwise. We do not provide any other form of financial advice, investment advice, tax advice or legal advice in connection with the Services.
To the extent that we provide market commentary or other information, such information shall not be considered investment advice or financial advice.
TÝR Markets will, to the best of its ability, notify clients promptly of any suspected or actual fraudulent activity or security threats via e-mail notifications.
If suspicious activity is detected on an Account, TÝR Markets will suspend the transaction and will request details from you via e-mail. Additionally, TÝR Markets provides phone intervention after manual reviews if a high risk of scam is suspected. Any such measures shall be without liability for Týr Markets.
In order to comply with regulations to prevent money laundering and terrorist financing, you must provide your full name, residential address, residency status, national identity number or D-number, as well as other legally required information, including information about the purpose and intended nature of the customer relationship, the origin of funds and tax affiliation, when creating your Account with TÝR Markets.
If you have neither a national identity number nor a D-number, you must provide date of birth, place of birth, citizenship and gender. You must identify yourself through approved electronic identification and confirm the accuracy of the information.
We reserve the right to reject, suspend, or terminate any customer relationship if, in our sole discretion, the results of our know-your-customer (KYC) verification are unsatisfactory, or if you fail to provide the documentation or information required.
TÝR Markets also reserves the right to refuse to establish or maintain your customer relationship where there is reason to believe that the information provided is false, incomplete, or otherwise insufficient to perform adequate due diligence, or if there is suspicion of money laundering, terrorist financing or other fraudulent behavior.
Under anti-money laundering regulations and rules on international sanctions, we have a duty to investigate the customer relationship and use of the Account. If we require it, you must provide information about your use of the Account, including providing information about and documenting the origin of funds. If you do not provide information we find satisfactory, or customer measures in our assessment cannot be carried out, we may refuse to accept deposits, execute orders and freeze the Account.
We also reserve the right to block transfers to or from you, at our sole discretion, if there is a suspicion of money laundering or terrorist financing, e.g. as a result of our ongoing monitoring and screening.
We have a duty to report suspicious transactions and activities to Økokrim. We have no duty to notify you of this and are not liable for measures Økokrim or other public authority may take or impose on us.
To implement the Agreement and to comply with legal obligations, we will process personal data about you. This will include identification and contact information, information related to transactions, income, expenses, assets and debts. We will also process personal data to prevent economic crime, money laundering and terrorist financing. We can amend this Agreement if we see a need to do it. Generally, we will only change the Agreement for the following reasons:
To make it easier to understand or more helpful to you
To reflect the way we operate our business or Services
To reflect legal or regulatory requirements that apply to us
To reflect changes in the cost of running our business
If we are changing or introducing new services or products that affect our existing Services or products covered by this Agreement
If we add a new product or service that does not affect our existing Terms, but that require acceptance from you before you use it, we may add it immediately and let you know before you use it. Please be informed that use of a new product or service will be considered as acceptance from your side of the accompanying terms for the product or service, including any accompanying changes to this Agreement. The same applies to any change to this Agreement that is notified to you before you use our Services.
We will always try to notify you of any changes to this Agreement through the platform before we implement any changes but cannot guarantee that we will always be able to do so. If you do not appreciate the changes, you can at any time terminate the agreement with us with 10 days' written notice. Termination of the Agreement requires you to sell or transfer all your assets held in the Account to another crypto asset service provider or to exchange any crypto-currencies held in your Account to fiat currency and request a withdrawal of all fiat currency held at your Account to your designated account. Our standard fees and charges will apply for any exchange of crypto-assets into fiat currency. We do not charge any fees for withdrawals of fiat currency. If we do not hear from you, or if you use our Services after we have notified you of any changes to these Terms, you will be considered having accepted the changes.
You accept that contract conclusions, notices, messages and other communication between us and you are made on our platform with secure login. It is your responsibility to familiarise yourself with information made available on your pages on the platform.
Messages sent by electronic communication shall be deemed to have been received by you from the time the message is published in your inbox on the platform or when the message is sent from us to your most recently notified electronic address.
For custody-related instructions, you must use the platform's secure login with strong customer authentication, and we may require additional authentication factors before executing any movement of assets.
Communication from us to you will generally be held in the English language. You may use Norwegian language in all correspondence to us if you'd prefer.
If you wish to complain, you can do so via the platform as instructed, or by email to complaints@tyrmarkets.net. More information about complaints and our complaint procedures can be found on our website.
This Agreement is subject to Norwegian law.
Any dispute related to this Agreement shall be attempted to be resolved amicably. If the parties do not reach an agreement, the case shall be resolved by the ordinary courts in Norway.
